Dana G. McFerran

Dana McFerran is a Partner in the Forensic practice for KPMG LLP. She has spent over 24 years focusing on financial statement analysis, financial reporting and general fraud and misconduct investigations, Foreign Corruption Practices Act investigations and due diligence procedures, the evaluation and monitoring of corporate and regulatory compliance programs, post-acquisition dispute arbitration matters, expert witness services, litigation support and damage claim analyses across all industries. Dana has conducted a wide variety of forensic accounting investigations in connection with management and Audit Committee investigations, DOJ, SEC and international enforcement proceedings. Many of these matters have resulted in assisting clients enhance their compliance programs and controls to help mitigate bribery and corruption and general compliance and fraud risks. Dana spent two years in KPMG's Audit practice prior to joining the Forensic practice.

Professional and Industry Experience

Dana has led numerous cross-border investigations in the Americas, EMEA and Asia Pacific regions in connection with SEC enforcement proceedings and DOJ investigations for global clients across Life Sciences and various other sectors. Many of these matters resulted in the development of enhanced written policies and procedures, remediation recommendations, development of compliance monitoring techniques and training programs. Representative engagements include:

• Provides continuous support in leading international teams investigating allegations of FCPA violations, financial statement improprieties and general fraud and misconduct activities for a global Life Sciences company. The matters focus on, but are not limited to, payments made to HCPs, consultants, agents, third party intermediaries for their operations in the EMEA and ASPAC regions.
• Led an international team investigating allegations of FCPA violations. The matter focused on service provider, consultant and distribution arrangements and payments for their operations in Brazil, Russia and CIS countries.
• Led an international investigation that involved allegations of earnings management, bribery and conflict of interest concerns in their European regions.
• Assisted with an investigation regarding alleged illegal bribes made by their management to foreign government delegations in Africa.
• Conducted an anti-bribery and corruption risk assessment and provided recommendations for compliance monitoring techniques and processes.
• Assisting a major global pharmaceutical company with their program to review and monitor sales and marketing activities.
